1. Strona internetowa www.edubears.pl (dalej: „Strona Internetowa”) jest prowadzana przez Edu Bears sp. z o.o. sp.k., ul. Pszczyńska 69, 44-100 Gliwice, NIP: 6312660560, REGON: 363 507 143, KRS: 0000748549, Sąd rejestrowy: Sąd Rejonowy w Gliwicach, X Wydział Gospodarczy Krajowego Rejestru Sądowego, office@edubears.pl, (dalej: „Administrator”).

2. W ramach działalności Strony Internetowej mogą być zbierane, przetwarzane i wykorzystywane dane użytkowników Strony Internetowej (dalej: „Użytkownicy”), w tym dane osobowe.

3. Dane Użytkowników mogą być zbierane w wyniku: ich dobrowolnego podania przez Użytkowników, stosowania plików cookies.

4. Zbierane mogą być ponadto informacje o adresie IP użytkownika, czasie nadejścia zapytania i wysłania odpowiedzi, adresie strony internetowej, z której użytkownik został przekierowany do Strony Internetowej oraz rodzaju oprogramowania, z którego korzysta użytkownik. Informacje te są wykorzystywane dla celów administrowania Stroną Internetową oraz tworzenia statystyk i analiz.

§ 2

2. Administrator za pośrednictwem Strony Internetowej może zbierać a następnie przetwarzać dane osobowe w celach takich jak:

1. skontaktowanie się z Użytkownikiem, jeśli ten wypełnił formularz kontaktowy,

2. zapewnienie prawidłowe działanie funkcjonalności Strony Internetowej (niezbędne pliki cookies);

3. wyświetlanie zamieszczonego przez Użytkownika komentarza do wpisu na blogu,

4. prowadzenia przez Administratora marketingu bezpośredniego własnych produktów lub usług, w tym przesyłania newslettera;

5. zawarcie i realizacja umowy sprzedaży dostępu do kursów online, a więc umowy, której stroną jest osoba, której dane dotyczą;

6. statystyki i analizy zachowań Użytkowników na stronach internetowych (statystyczne i marketingowe pliki cookies).

3. Administrator przetwarza dane osobowe w oparciu o następujące podstawy:

1. w przypadku danych przetwarzanych w celu skontaktowania się z Użytkownikiem – na podstawie prawnie uzasadnionego interesu Administratora, którym jest odpowiedź na pytanie zadane przez Użytkownika (art. 6 ust. 1 lit. f RODO);

2. w przypadku danych przetwarzanych w celu zapewnienia prawidłowego działanie funkcjonalności Strony Internetowej – na podstawie przetwarzania niezbędnego do realizacji umowy (art. 6 ust. 1 lit. b RODO);

3. w przypadku danych przetwarzanych w celu wyświetlania zamieszczonego przez Użytkownika komentarza – na podstawie prawnie uzasadnionego interesu Administratora, którym jest publikacja komentarza Użytkownika (art. 6 ust. 1 lit. f RODO);

4. w przypadku danych przetwarzanych w celu prowadzenia przez Administratora marketingu bezpośredniego własnych produktów lub usług, w tym przesłania newslettera – na podstawie prawnie uzasadnionego interesu Administratora, którym jest promowanie prowadzonej przez niego działalności (art. 6 ust. 1 lit. f RODO);

5. w przypadku danych przetwarzanych w celu zawarcia i realizacji umowy sprzedaży dostępu do kursów online – na podstawie przetwarzania niezbędnego do wykonania umowy (art. 6 ust. 1 lit. b RODO);

6. w przypadku danych przetwarzanych w celu prowadzenia statystyk i analiz – na podstawie prawnie uzasadnionego interesu Administratora, którym jest weryfikacja sposobu korzystania przez Użytkowników ze Strony Internetowej (art. 6 ust. 1 lit. f RODO).

4. W przypadku danych przetwarzanych w celu kontaktu z Użytkownikiem oraz statystyki i analizy zachowań Użytkowników na stronach internetowych Administrator może przetwarzać przez okres 3 lat od dnia ich zebrania. Komentarz wraz z informacją o jego autorze zamieszczony przez Użytkownika wyświetlany jest przez okres dostępności artykułu.

5. W przypadku danych przetwarzanych w celu prowadzenia przez Administratora marketingu bezpośredniego własnych produktów lub usług, w tym przesłania newslettera, Administrator może przetwarzać dane do momentu zgłoszenia sprzeciwu przez Użytkownika lub do momentu cofnięcia zgody na otrzymywanie informacji handlowej.

6. W przypadku danych przetwarzanych w celu zawarcia i realizacji umów, Administrator może przetwarzać dane przez okres wykonywania umów oraz okres niezbędny do dochodzenia własnych roszczeń lub obrony przed roszczeniami zgłoszonymi w stosunku do Administratora w związku z wykonywaną umową.

7. Administrator może udostępnić dane Użytkowników swoim podwykonawcom (podmiotom, z usług których korzysta przy przetwarzaniu) takim jak dostawcy usług i rozwiązań informatycznych.

8. Administrator może korzystać z dostawców usług informatycznych, którzy mają swoją siedzibę poza Europejskim Obszarem Gospodarczym. W związku z tym dane Użytkownika mogą zostać przekazane poza EOG. Administrator korzysta wyłącznie z usług dostarczanych przez podmioty mających siedzibę w krajach, co do których Komisja Europejska stwierdziła, że zapewniają one odpowiedni poziom ochrony, z podmiotów przetwarzających dane osobowe na podstawie Standardowych Klauzul Umownych przyjętych przez Komisję Europejską, o których mowa w art. 46 RODO, zawartych między Administratorem, a tym podmiotem, lub które przetwarzają dane w oparciu o zasady Data Privacy Framework.

9. Użytkownikowi, którego dane dotyczą przysługują następujące prawa:

1. prawo dostępu do danych osobowych oraz prawo otrzymania ich kopii;

2. prawo do sprostowania danych osobowych;

3. prawo do usunięcia danych osobowych;

4. prawo do żądania ograniczenia przetwarzania danych osobowych;

5. prawo do przeniesienia danych osobowych;

6. prawo sprzeciwu wobec przetwarzania danych osobowych;

7. prawo do wniesienia skargi do organu nadzorczego.

W celu skorzystania w powyższych praw, Użytkownik powinien skontaktować się z Administratorem.

§ 3

1. W ramach działalności Strony Internetowej wykorzystywane są pliki cookies zapisywane w urządzeniach końcowych Użytkowników. Przez wykorzystywanie plików cookies należy rozumieć ich przechowywanie i uzyskiwanie do nich dostępu przez Administratora.

§ 1
[General information]

1. The website www.edubears.com (hereinafter referred to as: the “Website”) is maintained by Edu Bears sp. z o.o. sp.k. z siedzibą ul. Wolności 347, 41-800 Zabrze, NIP: 6312660560, REGON: 363507143, KRS: 0000748549, e-mail: office@edubears.pl (hereinafter referred to as: the “Data Controller”).
2. The data of website Users (hereinafter referred to as: the “Users”), including personal data, may be collected, processed and used within the framework of the Website activity.
3. Users’ data may be collected as a result of: voluntary providing thereof by the Users themselves, use of cookies.
4. Additionally, the information on User’s IP address, query arrival and question sending time, address of a website from which a User was redirected to the Website and  a type of software used by a User may be collected. This information is used for the purpose of the Website administration and creation of statistics and analysis.

[Personal data]

1. The Data Controller of Users’ personal data is Edu Bears sp. z o.o. sp.k. z siedzibą ul. Wolności 347, 41-800 Zabrze, NIP: 6312660560, REGON: 363507143, KRS: 0000748549, e-mail: office@edubears.pl.
2. The Data Controller through the Website may collect and process the personal data for the purpose of:
1) contacting with a User if they have completed the contact form;
2) providing proper operation of the Website functionality (strictly necessary cookies);
3) displaying a comment posted by a User under a blog entry;
4) conducting direct marketing of its own products and services by the Data Controller, including sending the newsletter;
5) conclusion and performance of a contract of sale regarding the access to online courses, namely the contract whose party is a person whose data is considered;
6) creation of the statistics and analysis of Users’ browsing habits (performance and analytics cookies).
3. Data Controller shall process personal data in accordance with the following legislation:
1) in the case of processing data with the aim of contacting a User – in virtue of the legitimate interests pursued by the Data Controller, which constitute an answer to a question asked by a User (under Article 6 (1)(f) of the GDPR);
2) in the case of processing data with the aim of providing proper operation of the Website functionality – in virtue of processing necessary for the performance of a contract (under Article 6 (1)(b) of the GDPR);
3) in the case of processing data with the aim of displaying a comment posted by a User – in virtue of the legitimate interests pursued by the Data Controller, which constitute the publication of a User’s comment (under Article 6 (1)(f) of the GDPR);
4) in the case of processing data with the aim of conducting direct marketing of its own products and services by the Data Controller, including sending the newsletter – in virtue of the legitimate interests pursued by the Data Controller, which constitute the promotion of the activities of the Data Controller (under Article 6 (1)(f) of the GDPR);
5) in the case of processing data with the aim of conclusion and performance of a contract of sale regarding the access to online courses – in virtue of the processing necessary for the performance of a contract (under Article 6 (1)(b) of the GDPR);
6) in the case of processing data with the aim of creating statistics and analyses – in virtue of the legitimate interests pursued by the Data Controller, which constitute the verification of the manner in which Users use the Website (under Article 6 (1)(f) of the GDPR).
4. The Data Controller may share the Users’ data with its subcontractors (entities of which services the Data Controller uses while processing) such as service and software solutions providers.
5. The Data Controller may use IT service providers established outside the European Economic Area. Therefore, the User’s data may be transmitted outside the EEA. The Data Controller shall use entities that process personal data in virtue of standard data protection clauses adopted by the European Commission pursuant to Article 46 of the GDPR and entered into between the Data Controller and that entity.

In the event of data processed with the aim of contacting a User and creating statistic and analysis of the users’ browsing habits, the Data Controller may process the data for and during a period of three years from the date collection thereof. The comment with the information on the author thereof posted by a User is displayed as long as the article is available.
7. In the event of data processed with the aim of conducting direct marketing of its own products and services by the Data Controller, including sending the newsletter, the Data Controller may process data until the User objects to the processing or until the consent to receive commercial information is revoked.
8. In the event of data processed with the aim of conclusion and performance of contracts, the Data Controller may process data for the duration of contracts performance as well as for the period necessary for pursuing one’s own claims or defence against claims lodged against the Data Controller regarding the contract performance.
9. The following rights are guaranteed to the User whose data is considered:
1) the right of access to personal data including the right to obtain a copy thereof;
2) the right to obtain the rectification of personal data;
3) the right to obtain the erasure of personal data;
4) the right to obtain restriction of processing personal data;
5) the right to transmit personal data;
6) the right to object to processing of personal data;
7) the right to lodge a complaint with a supervisory authority;
