Wolności 347, 41-800 Zabrze, NIP: 631 266 05 60, KRS: 0000748549, e-mail: ba@edubears.com, tel: +48 603 799 712; 2) Akredytowanym Centrum – należy przez to rozumieć podmiot będący Licencjobiorcą Edu Bears sp. z o.o. sp. k., w którym prowadzone są kursy metodą The Bearton Twins; 3) Serwisie Internetowym – należy przez to rozumieć serwis znajdujący się pod adresem ba.beartontwins.com oraz dostępny w ramach aplikacji mobilnych na systemach Android oraz iOS; 4) Użytkowniku – należy przez to rozumieć podmiot korzystający z Serwisu Internetowego, przy czym kategoria ta obejmuje zarówno użytkowników nieposiadających Konta w Serwisie Internetowym, jak i Zarejestrowanych Użytkowników oraz Kursantów; 5) Zarejestrowanym Użytkowniku – należy przez to rozumieć podmiot korzystający z Serwisu Internetowego, który posiada Konto oraz który jest opiekunem prawnym Kursanta lub pracownikiem pracującym w Akredytowanym Centrum; 6) Kursancie – należy przez to rozumieć dziecko będące uczestnikiem kursu The Bearton Twins prowadzonego w Akredytowanym Centrum, któremu Zarejestrowany Użytkownik umożliwił lub zamierza umożliwić faktyczne korzystanie z Serwisu Internetowego; 7) Koncie – należy przez to rozumieć funkcjonalność Serwisu Internetowego, umożliwiającą po zalogowaniu się w Serwisie Internetowym za pomocą indywidualnego loginu i ustalonego hasła, dostęp do Zasobów w systemie informatycznym; 8) Zasobach – należy przez to rozumieć funkcjonalność Serwisu Internetowego umożliwiającą: a) wykonywanie ćwiczeń (dalej: „Ćwiczenia”), tj. funkcjonalności Serwisu Internetowego umożliwiającej wykonywanie ćwiczeń związanych z nauką języka angielskiego, zgodnie z poleceniami pojawiającymi się na ekranie; b) odsłuchanie nagrań i obejrzenie wideo będących częścią kursu The Bearton Twins w ramach danego poziomu. 4. W ramach działalności Serwisu Internetowego zbierane, przetwarzane i wykorzystywane są dane Użytkowników. W ramach działalności Serwisu Internetowego zbierane mogą być ponadto informacje o adresie IP Użytkownika, czasie nadejścia zapytania i wysłania odpowiedzi, adresie strony internetowej, z której Użytkownik został przekierowany do Serwisu Internetowego oraz rodzaju oprogramowania z którego korzysta Użytkownik. Informacje te są wykorzystywane dla celów administrowania Serwisem Internetowym. § 2 [Dane osobowe] 1. Wolności 347, 41-800 Zabrze, NIP: 631 266 05 60, KRS: 0000748549, e-mail: ba@edubears.com , tel: +48 603 799 712 W ramach działalności Serwisu Internetowego przetwarzane są następujące dane: 1) dane osobowe Zarejestrowanego Użytkownika w postaci adresu e-mail, podanego w Akredytowanym Centrum; 2) dane osobowe Kursanta w postaci imienia i nazwiska, podanego przez Zarejestrowanego Użytkownika w Akredytowanym Centrum; 3) dane Zarejestrowanego Użytkownika/Kursanta dotyczące korzystania z Serwisu Internetowego tj. dane dotyczące ostatnich logowań w Serwisie Internetowym, średniego czasu poświęcanego na wykonywanie Ćwiczeń i odtwarzanie Nagrań (stanowiących elementy Zasobów), preferencji w zakresie wyboru poszczególnych Ćwiczeń i Nagrań, rezultatów oraz efektywności wykonywanych Ćwiczeń; 4) adres e-mail oraz ewentualnie inne przekazane przez osobę dane, jeżeli są one niezbędne do celów związanych z udzieleniem odpowiedzi na przesłaną informację dotyczącą błędów aplikacji. 2. Dane osobowe są pozyskiwane przez Administratora w następujący sposób: 1) przez udostępnienie Administratorowi przez Szkołę Językową danych osobowych Kursantów i Zarejestrowanych Użytkowników, co do których została wyrażona zgoda na ich udostępnienie Administratorowi; 2) przez dobrowolne podawanie informacji przez Użytkowników w formularzu służącym do rejestracji w Serwisie Internetowym 1 lub w formularzu zgłoszenia błędów; 3) przez analizę zachowań (o których mowa w ust. 2, pkt 3) Użytkowników. 3. Przetwarzanie danych osobowych Zarejestrowanych Użytkowników i Kursantów następuje w celu: 1) umożliwienia założenia Konta w Serwisie Internetowym, umożliwienia dostępu do Serwisu Internetowego i korzystania z jego funkcjonalności – co stanowi przetwarzanie niezbędne do zawarcia i realizacji umowy o świadczenie usług drogą elektroniczną (art. 6 ust. 1 lit. b RODO); 2) w celu tworzenia statystyk dotyczących korzystania przez Zarejestrowanych Użytkowników i Kursantów z Serwisu Internetowego – co stanowi prawnie uzasadniony interes Administratora (art. 6 ust. 1 lit. f RODO); 3) w celu zwrotnego udostępnienia danych Akredytowanemu Centrum, w którym Kursant odbywa kurs językowy prowadzony metodą The Bearton Twins albo – w zakresie dotyczącym lektorów – w którym dany lektor prowadzi kurs językowy metodą The Bearton Twins, na potrzeby prowadzenia analizy statystycznej dotyczącej korzystania z Serwisu Internetowego przez konkretnych użytkowników – co stanowi prawnie uzasadniony interes Administratora (art. 6 ust. 1 lit. f RODO); 4) w celu prowadzenia przez Administratora marketingu bezpośredniego własnych produktów lub usług – przesyłania informacji handlowej – co stanowi prawnie uzasadniony interes Administratora (art. 6 ust. 1 lit. f RODO); 5) w celu odpowiedzi na korespondencję skierowaną do Administratora, dotyczącą zgłoszenia błędu w działaniu aplikacji, co jest prawnie uzasadnionym interesem Administratora (art. 6 ust. 1 lit. f RODO). 4. Dane osobowe przetwarzane są przez następujące okresy: 1) w przypadku danych przetwarzanych w celu zawarcia i realizacji umów, Administrator może przetwarzać dane przez okres wykonywania umów oraz okres niezbędny do dochodzenia własnych roszczeń lub obrony przed roszczeniami zgłoszonymi w stosunku do Administratora w związku z wykonywaną umową; 2) w przypadku danych przetwarzanych w celu tworzenia statystyk, Administrator może przetwarzać je przez okres 3 lat od dnia ich zebrania; 3) w przypadku danych przetwarzanych w celu zwrotnego udostępnienia danych Szkole Językowej, Administrator może przetwarzać je przez okres 1 roku od dnia ich zebrania; 4) w przypadku danych przetwarzanych w celu prowadzenia marketingu bezpośredniego, Administrator przetwarza je do momentu zgłoszenia sprzeciwu przez Użytkownika lub do momentu cofnięcia zgody na otrzymywanie informacji handlowej; 5) W przypadku danych przetwarzanych w celu odpowiedzi na zgłoszenie błędów, Administrator może przetwarzać dane osobowe przez okres 1 roku od momentu przesłania korespondencji. 5. Administrator może udostępnić dane Użytkowników swoim podwykonawcom (podmiotom, z usług których korzysta przy przetwarzaniu) takim jak dostawcy usług i rozwiązań informatycznych. 6. Administrator może korzystać z dostawców usług informatycznych, którzy mają swoją siedzibę poza Europejskim Obszarem Gospodarczym. W związku z tym dane Użytkownika mogą zostać przekazane poza EOG. Administrator korzysta z podmiotów, które przetwarzają dane osobowe na podstawie Standardowych Klauzul Umownych przyjętych przez Komisję Europejską, o których mowa w art. 46 RODO, zawartych między Administratorem a tym podmiotem. 7. Osobie, której dane dotyczą przysługują następujące prawa: 1) prawo dostępu do podanych danych osobowych oraz prawo otrzymania ich kopii; 2) prawo do sprostowania danych osobowych; 3) prawo do usunięcia danych osobowych; 4) prawo do żądania ograniczenia przetwarzania danych osobowych; 5) prawo do przeniesienia danych osobowych; 6) prawo sprzeciwu wobec przetwarzania podanych danych osobowych, jeśli przetwarzane są one w celu marketingu bezpośredniego; 7) prawo sprzeciwu wobec przetwarzania podanych danych osobowych z przyczyn związanych ze szczególną sytuacją, również w przypadku gdy dane są przetwarzane w innym celu niż marketing bezpośredni; 8) prawo do wniesienia skargi do organu nadzorczego. Wolności 347, 41-800 Zabrze, NIP: 631 266 05 60, KRS: 0000748549, e-mail: ba@edubears.com, tel: +48 603 799 712; 2) Accredited Center – it should be understood as an entity being a Licensee of Edu Bears sp.z o.o. sp. k., where The Bearton Twins courses are provided; 3) Service – it ought to be understood as the website located at ba.beartontwins.com and available as mobile applications on Android and iOS systems; 4) User – it should be understood as an entity using the Service, and this category includes both users who do not have an Account on the Service, as well as Registered Users and Students; 5) Registered User – it should be understood as an entity using the Service, who has an Account and who is the legal guardian of the Student or employee working in the Accredited Center; 6) Participant – it shall be understood as a child who is a participant of The Bearton Twins course conducted in the Accredited Center, to whom the Registered User has allowed or intends to enable the actual use of the Service; 7) Account – it ought to be understood as the functionality of the Service, which allows, after logging in to the Service with an individual login and a set password, access to Resources in the IT system; 8) Resources – it ought to be understood as the functionality of the Service enabling: a) performing exercises (hereinafter: „Exercises”), ie the functionality of the Service that allows you to perform exercises related to learning English, in accordance with the instructions appearing on the screen; b) listening to the recordings (hereinafter „Recordings”) that are part of The Bearton Twins course within a given level; 4. As part of the operation of the Service, Users’ data are collected, processed and used. As part of the Service’s activity, information may also be collected about the User’s IP address, the time of receipt of the inquiry and sending the answer, the address of the website from which the User was redirected to the Service and the type of software used by the User. This information is used for the purpose of administering the Service. § 2 [Personal data] 1. As part of the activities of the Service, the following data is processed: 1) personal data of the Registered User in the form of an e-mail address provided in the Accredited Center; 2) personal data of the Student in the form of the name and surname provided by the Registered User in the Accredited Center; 3) data of the Registered User / Student regarding the use of the Service, i.e. data regarding the last logins on the Service, the average time spent on performing Exercises and playing Recordings (constituting elements of the Resources), preferences in the selection of individual Exercises and Recordings, results and effectiveness of performed Exercise; 4) e-mail address and other data sent by the person, if necessary for the purposes of responding to the notification regarding application errors. 3. Personal data is obtained by the Administrator as follows: 1) by the Language School providing the Administrator with the personal data of the Students and Registered Users, for whom consent has been given for their disclosure to the Administrator; 2) by voluntarily providing information by Users in the registration form on the Service or in the error reporting form; 3) by analyzing the behavior of Users (referred to in section 2, point 3). 4. The processing of personal data of Registered Users and Students takes place in order to: 4 1) enabling the creation of an Account on the Service, enabling access to the Service and using its functionalities – which is the processing necessary to conclude and perform the contract for the provision of electronic services (Article 6 (1) (b) of the GDPR); 2) to create statistics on the use of the Service by Registered Users and Students – which is the legitimate interest of the Administrator (Article 6 (1) (f) of the GDPR); 3) in order to provide the data back to the Accredited Center, in which the Student takes a language course conducted using The Bearton Twins method, or – in the scope concerning teachers – in which a given teacher conducts a language course using The Bearton Twins method, for the purpose of conducting statistical analysis regarding the use of the Service by specific users – which is the legitimate interest of the Administrator (Article 6 (1) (f) of the GDPR); 4) in order for the Administrator to conduct direct marketing of his own products or services – sending commercial information – which is the legitimate interest of the Administrator (Article 6 (1) (f) of the GDPR); 5) in order to respond to a message sent to the Administrator regarding an error in the operation of the application – which is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR). 5. Personal data is processed for the following periods: 1) in the case of data processed in order to conclude and perform contracts, the Administrator may process data for the period of contract performance and the period necessary to pursue its own claims or defend against claims submitted against the Administrator in connection with the contract; 2) in the case of data processed for the purpose of creating statistics, the Administrator may process them for a period of 3 years from the date of their collection; 3) in the case of data processed in order to provide the data back to the Language School, the Administrator may process them for a period of 1 year from the date of their collection; 4) in the case of data processed for the purpose of direct marketing, the Administrator processes them until the User objects to it or until the consent to receive commercial information is withdrawn; 5) In the case of data processed in order to respond to error reports, the Administrator may process personal data for a period of 1 year from the moment of sending the message. 6. The Administrator may make Users’ data available to its subcontractors (entities that use the services for processing), such as providers of IT services and solutions. 7. The administrator may use IT service providers established outside the European Economic Area. Therefore, the User’s data may be transferred outside the EEA. The administrator uses entities that process personal data on the basis of Standard Contractual Clauses adopted by the European Commission, referred to in art. 46 of the GDPR, concluded between the Administrator and this entity. 8. The data subject has the following rights: 1) the right to access the personal data provided and the right to receive a copy thereof; 2) the right to rectify personal data; 3) the right to delete personal data; 4) the right to request the restriction of the processing of personal data; 5) the right to transfer personal data; 6) the right to object to the processing of the personal data provided, if they are processed for the purpose of direct marketing; 7) the right to object to the processing of the personal data provided for reasons related to a particular situation, also when the data is processed for a purpose other than direct marketing; 8) the right to lodge a complaint with the supervisory authority. 9.
